Tory Lanez’s Lawyers File Bail Motion While Appealing 10-Year Sentence – Latest Updates

Tory Lanez‘s legal team has submitted a motion to release the rapper on bail as they work to get his 10-year sentence for shooting Megan Thee Stallion appealed.

Lanez was handed down his sentence for the July 2020 shooting earlier this month. He is presently confined within Los Angeles County Jail, with few privileges.

According to court reporter Meghann Cuniff, who has been closely following the case, a request for “bail on appeal” was filed for Tory in Los Angeles on Monday, August 28. A hearing regarding this motion is set for September 5.

“Ask and ye shall receive: Tory Lanez’s lawyers appear to have filed a motion to bail him out of jail as he appeals his judgment and sentence for shooting Megan Thee Stallion,” Cuniff wrote on Twitter/X.

She added: “Regarding actual motion, DA’s office says they weren’t aware anything was filed and haven’t received anything yet, but ‘132 has been dark’ which refers to Judge Herriford’s dept # and means he’s been out. But public docket entry is yesterday, hearing is scheduled for Tuesday.”

The hearing is scheduled to take place infront of Judge David Herriford, who oversaw the trial in December 2022 and handed down a ten-year prison sentence to Lanez.

The filing comes following an online exchange between Tory Lanez’s defense attorney, Jose Baez, and Meghann Cuniff. She raised concerns about his dedication to the rapper’s appeal process due to his vacationing in Italy.

“2+ weeks since Tory Lanez’s lawyer Jose Baez said he’d file a motion to bail Lanez out of jail as he appeals his convictions and 10-year prison sentence,” she wrote on Friday (August 25). “No motion has been filed, and I’m not sure how much of a priority it is for Baez: He’s posting Instagram stories from Italy.”

Baez addressed it via his Instagram Stories on Sunday (August 27). In his response, he referred her as a “blogger” and alleged that she has shown “bias” against Tory Lanez throughout her reporting of the trial.

The defense attorney also provided an update on Tory’s appeal, mentioning they can’t file the appeal motion until certain legal requirements are met. Despite this, they are making good progress in the fight for Tory’s freedom. He further mentioned that Lanez is currently “evaluating ALL of his options.”

Cuniff responded to Baez, writing on X: “Ignoring the unprofessional comments, the takeaway from Jose Baez’s Instagram stories today is he’s no longer sure if he’ll file a motion for bail pending Lanez’s appeal: ‘As for other motions, Tory is evaluating ALL of his options.’”

She also uploaded a screenshot on Instagram showing an email conversation with Baez, in which he praised Cuniff and assured her that he would “always be respectful towards” her.

Tory Lanez is currently being held apart from the regular inmates in an ‘administrative segregation unit,’ designed for individuals who can’t be safely housed with others. He’s allowed only two hours out of his cell each day.

In addition, the 31-year-old Tory Lanez is allowed only three hours of outdoor time each week for his mandated recreation period. Jail staff also check on him every 30 minutes, following the usual procedure in the administrative segregation unit.

As a small comfort, Lanez is “able to load up on goodies at the commissary.”

Tory Lanez is likely to experience this highly restricted routine for a few more weeks until he’s moved to an intake center. At that stage, he’ll find out which California prison he’ll be staying in for the duration of his sentence.

Although he was originally sentenced to ten years in prison, Meghann Cuniff revealed that Tory Lanez will have about a year deducted because of time he has already spent behind bars.

“Lanez will be credited for 231 days he’s already spent in jail, and he gets 15% credit of 34 days,” Cuniff tweeted last week. “[Judge] Herriford also is crediting his 40 days of house arrest, for a total of 305 days.”
