Tory Lanez‘s request for a new trial in the Megan Thee Stallion shooting case has been denied, despite having pleaded with the judge for a re-trial earlier this week.
On May 9, news was revealed by James Queally, a reporter for the Los Angeles Times, that Judge David Herriford had denied the motion for a new trial put forth by Canadian rapper after his attorneys Matthew Barhoma and Jose Baez had presented their case in front of him on Monday (May 8).
In an attempt to sway the judge, Lanez’ legal team contended that his former defense attorney, George Mgdesyan, provided inadequate representation and emphasized that no trace of Tory’s DNA was found on the weapon. However, despite these arguments, the judge remained unmoved.
“Tory Lanez motion for a new trial has been denied,” Queally tweeted. “We don’t have a sentencing date yet.”
He continued: “Attorney Jose Baez and the Lanez team did file a motion disqualify Judge Herriford — I don’t know on what grounds we don’t have copies yet — but Herriford still issued his ruling. That matter will likely be heard outside the county at some point (and that’s also a very high bar.)
“There will be more in the afternoon: defense wanted to ask Herriford to confirm he’s denying their due process claims (not relevant at present) and a sentencing date could be set.”
At the aforementioned hearing, Lanez recently disclosed that Baez had “hired one of the best DNA experts in the nation to carefully analyze the same DNA test,” finding that his DNA “is 100 percent excluded and 100 percent eliminated from the gun.” During the trial, the DNA test’s results were “inconclusive”.
However, the judge questioned Barhoma and Baez over the lack of objections to the DNA during the trial. In response, Barhoma said that although Holley had informed the court that she was hiring her own DNA expert, “that turned out to be false.” It took another eight months to recruit an expert who “was not adequately prepared,” according to Baez.
Tory begged Judge Herriford to grant him another chance at freedom as he was handcuffed and escorted out the courtroom. “Please don’t ruin my life. I could be your son. I could be your brother,” he told the judge (who is Black). Herriford didn’t say anything back.
In July 2020, Tory (Daystar Peterson) allegedly fired several gunshots at Megan during an drunken dispute outside Kylie Jenner’s residence in Hollywood Hills, ultimately injuring her feet.
